Envoy Asks UN for Sanctions Against
Nations Not Complying with
War Crime Prosecutions
UNITED NATIONS, July 2 (Reuters) - Bosnia's U.N. envoy called on the Security Council on Tuesday to impose sanctions on those parties which failed to comply with the orders of the international war crimes tribunal for the former Yugoslavia.
In a letter to Council President Alain Dejammet of France, ambassador Muhamed Sacirbey also said the council should call on the NATO-led Implementation Force (IFOR) helping carry out the Bosnia peace accords to arrest and extradite indicted war criminals for trial by the tribunal at The Hague. Elections due to be held in Bosnia in September could not be considered legal while the tribunal's orders were ignored, he added.
"Unfortunately, it is abundantly clear that some of the parties to the Dayton/Paris accords are neither committed to the future of the tribunal nor to that of the peace agreement," Sacirbey wrote.
Over six months after the accords were initialled at Dayton, Ohio, and signed in Paris, only the government of Bosnia and Herzegovina had fully cooperated with the tribunal and its orders, as required by the agreements, he added. "Now it is up to the Security Council to decide how it will respond to the challenge of the future of the tribunal and peace," Sacirbey said, recalling that tribunal president Judge Antonio Cassese had called on the council to compel cooperation with the war crimes court.
"We call upon the Security Council to undertake the necessary steps, all within its purview, to safeguard the peace as well as the tribunal," Sacirbey said. "First, the council has to promptly... sanction those parties that do not comply with the orders of the tribunal. Second, in the absence of full compliance, the Security Council should call upon IFOR to arrest and extradite indicted war criminals to The Hague.
"Finally, it must be clear that elections while the tribunal's orders are ignored cannot be considered legal, nor free and fair," Sacirbey said.
